3M’s Defective Earplugs
Last year, 3M agreed to a $9.1 settlement with the U.S. Department of Justice (DoJ) regarding the company’s liability under the False Claims Act based on alleged defects affecting 3M’s Dual-Ended Combat Arms Earplugs. According to allegations, the earplugs were too short to provide effective hearing protection and would easily come loose.
3M allegedly know about the defective properties of its earplugs but refused to notify the military about it. Under the terms of the settlement, no findings were made about the allegations in the DoJ’s action against 3M.
